Platform Terms of Service and Software License

Effective and last updated: September 16, 2026

These Terms govern use of AgentAfterburner, operated by Agent Afterburner LLC. Final notice address, dispute procedure and liability provisions should be reviewed by Florida counsel before public launch.

1. Agreement and authority

These Terms bind each user and the organization for which the user accepts them. An organization user represents authority to bind it. Administrators may manage authorized access, supervision, records and billing within their workspace.

2. Limited license and acceptable use

Subject to payment and compliance, Agent Afterburner LLC grants a limited, revocable, nonexclusive, nontransferable license for authorized real-estate business. Users may not reverse engineer, scrape, resell, circumvent security, misuse credentials, upload malware, infringe rights, discriminate, make deceptive claims, access another person’s data or automate consequential decisions without required human review.

3. Customer data

Customers retain their rights in lawfully uploaded transaction files, CRM records and other content and authorize processing reasonably necessary to provide, secure, support and transmit the service. Users must have authority to upload and share every record and comply with privacy, fair-housing, advertising, retention and do-not-contact rules.

4. AI, Atlas learning and professional verification

AgentAfterburner is workflow and decision-support software—not a law firm, brokerage, title company, surveyor, architect, engineer, environmental consultant, appraiser, inspector, lender, insurer, tax adviser or permitting authority. AI, OCR, MLS and public-record outputs may be incomplete, delayed, mismatched or wrong. Absence of a warning is never clearance. Users must read controlling contracts and independently verify material information with authoritative sources and appropriately licensed professionals before relying, sharing, presenting, submitting, signing, or acting.

Atlas may use de-identified aggregate negotiation-outcome patterns when a brokerage enables Anonymous Network or Enterprise Private learning. Learning permission never expands retrieval permission: users may retrieve only transaction records they are independently authorized to access. Aggregate patterns are historical evidence, not predictions, market facts, legal rights, or proof of any specific counterparty's intent.

5. Forms, signatures, records and integrations

Users are responsible for form licenses and versions, brokerage approval, disclosures, recipients, routing, delivery and completed signatures. Calendar, email and delivery status are conveniences—not proof of legal notice. MLS, forms, payment, cloud, email, signature, mapping and data providers have separate terms, fees and availability; AgentAfterburner does not guarantee them.

6. Subscriptions and missed payments

Fees, renewals and taxes are shown at purchase. A failed payment triggers account notice and may receive a seven-day recovery window. If unresolved, paid visibility and write access may be locked until payment is confirmed. Records remain restricted under the Privacy Notice and applicable retention duties; suspension does not automatically delete transaction files.

7. Confidentiality and security

Each party will protect the other’s nonpublic information with reasonable safeguards and use it only for this agreement. Users must protect credentials and report suspected compromise. Agent Afterburner LLC may preserve evidence and restrict access to investigate abuse, comply with law or protect users.

8. Merger, sale or acquisition

Agent Afterburner LLC may assign this agreement and transfer the service, contracts, accounts, customer data and other assets in financing, reorganization, merger, acquisition, equity or asset sale, bankruptcy or a similar corporate transaction. Recipients remain subject to applicable law, confidentiality duties and privacy commitments for data already collected, except for lawful prospective changes under Section 9. A corporate transfer is not a public sale of customer files.

9. Future changes

Agent Afterburner LLC may update these Terms and the Privacy Notice prospectively. Material changes receive legally required notice and may require renewed clickwrap acceptance, consent, or an opportunity to stop the affected use or opt out. Changes do not authorize unlawful retroactive processing. A successor proposing materially different data uses—including a sale or sharing regulated by privacy law—must provide required notice and choices and obtain consent where required.

10. Suspension, retention and termination

Access may be suspended or terminated for nonpayment, security risk, illegality, infringement, fraud or material breach. On termination, access ends subject to an export window and organization controls. Records may be retained for legal, regulatory, security, backup, dispute and brokerage-record duties, then deleted or de-identified under the Privacy Notice.

11. Disclaimers, liability and indemnity

TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE,” WITHOUT IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS, TITLE, NON-INFRINGEMENT, ACCURACY OR UNINTERRUPTED AVAILABILITY. Agent Afterburner LLC excludes indirect, special, incidental, consequential, exemplary and punitive damages, lost profits, lost data, missed deadlines, failed transactions, failed negotiations, third-party outages, customer configuration errors, and reliance on unverified output to the extent lawful. Customers remain responsible for controlling documents, deadlines, legal notices, professional decisions, permissions, backups required by law or brokerage policy, and review of client-facing output. No historical Atlas pattern guarantees acceptance, price, concession, closing or economic result. Final aggregate liability cap, indemnity procedure, statutory carve-outs and enforceability should be reviewed by counsel.

12. Florida law, disputes and notices

Florida law governs, excluding conflict rules. Final venue, arbitration, small-claims rights, class-waiver, opt-out and statutory carve-outs should be reviewed by counsel before public production. Nothing limits rights that cannot lawfully be waived. Agent Afterburner LLC is the operating company for the AgentAfterburner service.
